These terms are the agreement between you and pigeon. They cover the app, this website, and the nest. They are
written to be read, so please read them, especially sections 10 and 11, which limit what we are liable for.
1. the agreement
pigeon is operated by Max Chen, a sole proprietor based in
Ontario, Canada. By making an account, downloading the app, or using this website, you agree
to these terms and to our
privacy policy. If you do not agree, do not use pigeon.
If you use pigeon on behalf of a school, class, or organisation, you confirm you are allowed to accept these
terms for them.
2. who can use pigeon
You must be at least 13 years old. If the GDPR applies to you, you must be at least 16, or have permission
from a parent or guardian if your country sets a lower age. If you are under the age of majority where you
live, a parent or guardian must agree to these terms with you.
You also need to be legally allowed to use the service where you are, and not be banned from it by us.
3. your account
Give us accurate information, keep your password to yourself, and tell us promptly if you think someone else
has got into your account. You are responsible for what happens under your account.
One account per person. Do not sell, rent, or transfer your account, and do not impersonate anyone else or
pick a username designed to make people think you are someone you are not.
4. your content
Your timelapses, captions, comments, bio, and profile picture stay yours. We do not claim ownership of
anything you make.
To actually run the service, we need permission to handle it. You grant us a worldwide, non-exclusive,
royalty-free licence to host, store, reproduce, and display your content, and to show it to the people you
share it with, for the purpose of operating and improving pigeon. That licence ends when you delete the
content or your account, except for copies in backups that are on their way out, and copies other users have
already saved.
By posting, you confirm that:
you own it or have the rights to post it
everyone recognisable in the recording agreed to be filmed and posted
it does not break the law or infringe anyone else’s rights
Remember what a timelapse is. It is a camera recording of the space in front of you. Do not
record other people without their agreement, and do not record anything you would not want to be public.
We do not pre-screen posts, but we may remove content or suspend an account that breaks these terms, and we
will act on reports made through the support form.
5. what you cannot do
Do not:
harass, bully, threaten, or target anyone
post sexual content involving minors, or any sexual content without consent (this gets reported)
post hate speech, violent threats, or content that promotes self-harm
record or post other people without their permission
post spam, scams, or bulk promotional content
fake your study data, or use scripts and bots to inflate streaks, totals, or likes
scrape the service, or hammer our systems with automated requests
break, probe, or work around our security or rate limits, or access accounts that are not yours
reverse engineer the app except where the law says you may
upload malware, or use pigeon for anything illegal
Cheating your own stats mostly wastes your own time, but doing it to win a leaderboard or mislead a group is a
violation and we will reset or remove the data.
6. public posts and other people
The feed is public. Anything you post can be seen, linked to, and screenshotted by other people, including
people without an account. Treat it as public the moment you publish it.
Other users’ content belongs to them, not to us. We are not responsible for it, we do not endorse it,
and you use it at your own risk. Do not repost someone else’s session as your own.
7. our content and brand
The pigeon name, logo, mascot, app design, and code are ours and are protected by intellectual property law.
You may use pigeon as intended; you may not copy our branding, pass off a product as ours, or use our marks
without written permission.
8. availability and changes
pigeon is offered as-is and as-available. We may add, change, or remove features, and we may pause the
service for maintenance. We will try to give notice of significant changes, but we do not promise
uninterrupted service, and we are not liable for data lost because of an outage.
Keep your own copies of anything you cannot afford to lose. pigeon is not a backup service.
pigeon is free at the time of writing. If we introduce paid features, we will set out the pricing and terms before you are charged.
9. ending your account
You can stop using pigeon and delete your account whenever you like, from the app or by emailing us. See the
privacy policy for what deletion removes.
We may suspend or terminate your account if you break these terms, if we are required to by law, or if your
use puts other users or the service at risk. Where it is reasonable to do so, we will tell you why and give
you a chance to respond. Serious violations result in immediate removal, especially anything involving the
safety of minors.
Sections 4, 7, 10, 11, 12, and 13 survive the end of your account.
10. disclaimers
To the fullest extent the law allows, pigeon is provided without warranties of any kind, whether express or
implied, including implied warranties of merchantability, fitness for a particular purpose, and
non-infringement. We do not warrant that the service will be error-free, secure, uninterrupted, or that your
study data, streaks, or focus measurements will be accurate.
pigeon is a study tracker, not an academic, medical, or mental health service. It does not provide advice,
and it is not a substitute for professional help.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to
you. Nothing here limits consumer rights you have by law.
11. limitation of liability
To the fullest extent the law allows, neither pigeon nor its operators, employees, or suppliers are liable for
indirect, incidental, special, consequential, or punitive damages, or for lost data, lost profits, lost
opportunities, or damage to reputation, arising out of your use of the service.
Our total liability for any claim relating to pigeon is limited to the greater of the amount you paid us in
the twelve months before the claim, or twenty Canadian dollars (CA$20).
Nothing in these terms excludes liability for death or personal injury caused by negligence, for fraud or
fraudulent misrepresentation, or for anything else that cannot be excluded by law.
12. indemnity
You agree to indemnify and hold us harmless from claims, damages, and reasonable legal costs arising from
content you posted, your breach of these terms, or your violation of someone else’s rights. This does
not apply to the extent the claim is caused by us.
13. governing law and disputes
These terms are governed by the laws of the Province of Ontario and the federal laws of
Canada that apply there, and the courts of Ontario have exclusive
jurisdiction. If you are a consumer, you keep the right to
bring proceedings in the courts of the country where you live, and you keep the protection of that
country’s mandatory consumer laws.
Before starting formal proceedings, please contact us through the support form so we
can try to resolve it. Most problems are a misunderstanding or a bug.
If any part of these terms is found unenforceable, the rest stays in force. Our not enforcing a term
immediately does not mean we have waived it. These terms, together with the privacy policy, are the whole
agreement between us.
14. changes to these terms
We may update these terms. When we do, we change the date at the top, and for material changes we will give
notice in the app or by email before they take effect. If you keep using pigeon after that, you accept the new
terms. If you do not agree, delete your account.
